Terms and Conditions

We are Capstone Insurance Brokers LLC. The following are the terms of use that govern use of the WhatsApp BOT (“Terms of Use”). By using the Bot, you expressly agree to be bound by these Terms of Use and the Capstone privacy policy and to follow these Terms of Use and all applicable laws and regulations governing use of the Bot. Capstone reserves the right to change these Terms of Use at any time, effective immediately upon posting on the link shared on the Bot. Please access this link periodically. We will note when there are updates to the Terms of Use at the bottom of the Terms of Use. If you violate these Terms of Use, Capstone holds the right to take any appropriate legal action against you.

In this agreement unless the context indicates otherwise:

“Broker” means Capstone Insurance Brokers LLC, a company organised and existing under the laws of Dubai, UAE and licensed by the UAE Insurance Authority with its principal place of business located at Burj Al Salam, 7th floor, 6th Street Trade Centre, No. 2 Sheikh Zayed Road, PO Box 93469, Dubai – UAE

“Quotation” means Life insurance quote submitted through the Bot;

“Bot” means the WhatsApp interaction Bot operated and controlled by Capstone;

“Purchaser” means any person or persons, jointly and severally, who purchase insurance products through this Platform.

In these terms & conditions, Quote Issuance means the delivery of an indicative quotation as a Customer’s Electronic Quotation. This is not a Policy hence we are not responsible or liable for any coverage or benefit unless the Policy is issued by the insurance provider after submitting all required documents and details.

Quotation can be issued in 15 minutes once we have collected all the relevant documents and receive your confirmation on the required details. Exceptions can be faced during technical issues with the bot.

All quotations are indicative, and, in some cases, we might require approval from the insurance company/provider prior to the policy issuance which can be attained only during their official working hours.

Any changes in the information provided will directly impact on the indicative quotation.

We are not liable to you for loss or damage (including damages for consequential loss, loss of profits or punitive damages) that you suffer as a direct or indirect result of:

Information on this Bot being inaccurate or incomplete;

A Participating Insurer making an error in its coverage or its price quoted to you;

Your provision of incomplete, inaccurate or misleading information to us or to a Participating Insurer;

Your inability to use our Bot at any time for any reason including downtime, malfunctions or interruptions;

Errors or omissions in the details provided;

Any loss of or access to personal information beyond our control;

Any distributed loss of service attack, viruses or technologically harmful material that may infect your computer equipment, programs, data or other proprietary material resulting from use of the Bot or downloading material from it;

Loss of personal data or other data, howsoever caused, including without limitation, malfunctioning of the Bot, power failures, unlawful access to, or theft of, data, viruses, programming defects or negligence on our part; or any event beyond our control.

You may be required, as a condition for the confirmation of availing a quotation, to produce and share certain personal documents. Once shared and verified your indicative quote will be produced.

REPRESENTATIONS BY YOU: By using the Bot, you represent, warrant and covenant that (a) you are at least 18 years old; (b) that all materials of any kind submitted by you to Capstone Insurance Brokers through the Bot will not plagiarize, violate or infringe upon the rights of any third-party including trade secret, copyright, trademark, trade dress, privacy, patent, or other personal or proprietary rights. The customer using the Bot who are Minor /under the age of 18 shall not register as a User of the Bot and shall not transact on or use the Bot.

VIOLATION OF TERMS OF USE: You understand and agree that in COMPANY’s sole discretion, and without prior notice, Capstone may terminate your access to the Bot, or exercise any other remedy available and remove any unauthorized user information, if Capstone believes that the information you provide has violated or is inconsistent with these Terms of Use, or violates the rights of COMPANY, or any third party, or violates the law. You agree that monetary damages may not provide a sufficient remedy to Capstone Insurance for violations of these Terms of Use and you consent to injunctive or other equitable relief for such violations. Capstone may release user information about you if required by law or subpoena.

Policy issuance: Policies and procedures, Turnaround time and any requirements for policy issuance will be followed as per the insurance company’s guidelines.
